These Terms govern your access to and use of www.bayarku.my. By using our website, creating an account, or placing an order, you agree to these Terms together with our Privacy Policy, Refunds and Return Policy, and Anti-Bribery Policy.

About BAYARKU

BAYARKU SDN. BHD. is a branded merchandise e-commerce store based in Malaysia. We sell branded merchandise directly to customers through our website at www.bayarku.my. BAYARKU currently sells and ships within Malaysia only.

Eligibility and Account Registration

To place an order, customers are required to create an Account. You are responsible for maintaining the confidentiality of your login details, password, and any activity under your Account. Notify us immediately if you suspect unauthorised access or misuse. We reserve the right to suspend or terminate any Account used for fraudulent activity, abuse of promotions, or breach of these Terms.

Product Information

We aim to ensure product information, images, descriptions, prices, and availability are accurate. Minor differences may occur due to screen settings, photography, or production variation. We reserve the right to correct errors, update product information, or cancel affected orders where information is inaccurate or listed in error.

Orders and Acceptance

Placing an order is an offer to purchase. An order or payment confirmation does not automatically mean acceptance. We may cancel or reject an order for reasons including product unavailability, pricing errors, payment issues, suspected fraud, incorrect delivery information, or breach of these Terms.

Pricing and Payment

All prices are in Malaysian Ringgit. Prices may change without prior notice. The final payable amount may include product price, shipping fee, taxes, or other charges shown at checkout. Payment methods available on our website may be processed by third-party payment providers subject to their own terms.

Store Credit

1 BAYARKU store credit = RM1 for eligible purchases on www.bayarku.my only. Store Credit is not cash, not transferable, not interest-bearing, and cannot be withdrawn or exchanged for cash. BAYARKU may adjust, reverse, or cancel Store Credit in cases of error, fraud, chargeback, or system issues.

Shipping and Delivery

BAYARKU ships within Malaysia only via third-party couriers. Delivery times are estimates. You are responsible for providing a complete and accurate delivery address. Non-receipt must be reported within 14 days from the shipment date. Orders not reported within 14 days may be treated as received.

Returns, Refunds, and Replacements

BAYARKU provides a 7-day return and refund guarantee, subject to our Refunds and Return Policy. Requests must be submitted within 7 days of receipt with clear photo and/or video evidence. Resolutions may include a refund, replacement, exchange, partial refund, or store credit at our discretion.

Reviews and User Content

Submitted reviews and content must be truthful, lawful, and not misleading, offensive, or defamatory. By submitting content, you grant BAYARKU a non-exclusive right to use, store, display, and moderate it for platform operation, customer support, product improvement, and legal compliance.

Prohibited Activities

  • Providing false, misleading, or incomplete information.
  • Using another person's account, identity, or payment method without permission.
  • Interfering with the operation or security of our website.
  • Abusing promotions, store credit, refunds, or return processes.
  • Submitting false claims, fake evidence, or fraudulent refund requests.
  • Infringing BAYARKU's or any third party's intellectual property rights.
  • Acting in any way that damages BAYARKU's business, reputation, users, or systems.

Anti-Bribery and Anti-Corruption

BAYARKU is committed to conducting business ethically. Customers, suppliers, and business partners must not offer, request, or accept bribes or improper benefits to influence any order, refund, review, or business decision. Please refer to our Anti-Bribery Policy for details.

Limitation of Liability

To the fullest extent permitted by law, BAYARKU shall not be liable for indirect, incidental, or consequential losses including loss of profits, loss of data, or delivery delays caused by courier failures or third-party service issues. Our total liability for any order-related claim is limited to the amount paid by the customer for the affected order.

Complaints and Dispute Resolution

If you have any issue, please contact us first at admin@bayarku.my. We will attempt to resolve disputes amicably and in good faith. Unresolved disputes may be referred to the appropriate Malaysian court, tribunal, or arbitration process.

Governing Law

These Terms of Service are governed by the laws of Malaysia. Any dispute arising from our website, products, services, or account use shall be handled in Malaysia.

Changes to These Terms

BAYARKU may update these Terms from time to time. Any changes will be posted on our website with an updated effective date. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.
